Survivor’s Trust

A survivor’s trust is a type of trust typically used by married couples who have a joint trust agreement or a trust designed to split into separate parts, and goes into effect after the first spouse’s death. 

The survivor’s trust is typically the portion of the trust that contains the surviving spouse’s share of the couple’s assets, along with any property that the surviving spouse may inherit outright from the deceased spouse. The surviving spouse has complete control over all aspects of the survivor’s trust.
