A QTIP election, or qualified terminable interest property election, allows a person to leave assets to their spouse in a trust free of estate tax while controlling how those assets are distributed after the spouse dies.
Where estate tax might be due, a QTIP election allows for a marital deduction for the portion of an estate that qualifies.
